This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from www.icecastles.com, purchase tickets, visit an Ice Castles location, or participate in Castle Quest (collectively, the “Site” or “Services”), operated by Ice Castles, LLC (“Ice Castles,” “we,” “us,” or “our”). This Policy applies to visitors in the United States and Canada.

PERSONAL INFORMATION WE COLLECT

Device Information. When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information.”

We collect Device Information using the following technologies:

  • “Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier. For more information about cookies, and how to disable cookies, visit http://www.allaboutcookies.org.
  • “Log files” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.
  • “Web beacons,” tags,” and “pixels” are electronic files used to record information about how you browse the Site.

Order Information. When you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers), email address, and phone number. We refer to this information as “Order Information.”

Marketing Sign-Up Information. When you sign up for email or SMS updates (including through our email or SMS update form), we collect your email address, phone number, and location preference. This is processed on our behalf by our SMS/email marketing platform, Hive.

Castle Quest Information. Castle Quest is an interactive experience available at Ice Castles locations. It involves two distinct types of data collection:

  • Gameplay data (anonymous, device-based). Castle Quest is not account-based — there are no user profiles. Gameplay activity (scores, challenges completed, location/movement within the venue) is associated with a temporary device identifier, not with your name or identity. This data is automatically deleted approximately 24 hours after each session. We do not link this device-based gameplay data to any individual’s identity unless that person separately opts in to marketing (see below).
  • Marketing opt-in data (identified, persistent). Separately, if you choose to provide your email address and/or phone number to receive Ice Castles offers and updates, that is a distinct, affirmative opt-in, collected only with your consent, and retained until you unsubscribe or request deletion. This information is not automatically linked to your Castle Quest gameplay activity.

Participation in Castle Quest itself is never required to purchase a ticket or enter an Ice Castles attraction, and providing contact information for marketing is a separate, optional step.

When we talk about Personal Information in this Privacy Policy, we are talking about Device Information, Order Information, Marketing Sign-Up Information, and Castle Quest Information together.

HOW DO WE USE YOUR PERSONAL INFORMATION?

We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to:

  • Communicate with you;
  • Screen our orders for potential risk or fraud; and
  • Only where you’ve opted in, provide you with information or advertising relating to our products or services.

We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

We use Castle Quest Information to operate and personalize the Castle Quest experience, and — only for users who opt in — to send marketing communications and tailor offers based on gameplay activity.

SHARING YOUR PERSONAL INFORMATION

We share Personal Information with third-party service providers who help us operate the Site and Services, including:

We do not sell your Personal Information for monetary consideration. We may also share Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

BEHAVIORAL ADVERTISING

As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. DO NOT TRACK

Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser.

MARKETING CONSENT — EMAIL & SMS

We only send marketing emails or texts to people who have affirmatively opted in through an unchecked-by-default checkbox. Consent to marketing is never required to purchase tickets or enter an Ice Castles location.

SMS (US): Message and data rates may apply. Message frequency varies. Reply STOP to cancel, HELP for help. Consent is not a condition of purchase.

Canada (CASL): For contacts in Canada, every commercial electronic message will identify Ice Castles as sender, include a valid mailing address and contact information, and provide a working unsubscribe mechanism honored within 10 business days. We maintain records of consent.

You may withdraw consent anytime via the unsubscribe link, replying STOP, or contacting us directly.

YOUR RIGHTS

European residents: If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through the contact information below.

Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above. Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States.

US state residents: Depending on your state (e.g., California under CCPA/CPRA, Colorado, Connecticut, Virginia, Utah), you may have the right to know/access, delete, correct your personal information, opt out of sale/sharing or targeted advertising, and limit use of sensitive personal information (including Castle Quest location data). Contact us to exercise these rights.

Canadian residents: Under PIPEDA and applicable provincial law, you may access, correct, or request deletion of your information, and file a complaint with the Office of the Privacy Commissioner of Canada.

DATA RETENTION

When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information. Marketing Sign-Up Information and Castle Quest marketing opt-in data is retained until you withdraw consent or request deletion, whichever comes first. Castle Quest anonymous gameplay data (device ID, scores, in-venue location) is automatically deleted approximately 24 hours after each session and is not retained long-term.

MINORS

The Site is not intended for individuals under the age of 13. Castle Quest gameplay itself does not collect personal information or create profiles it is anonymous, device-based, and purged daily. The marketing opt-in (email/phone) is intended for adults; the opt-in checkbox includes a self-certification that the person providing the information is 18 or older. Because SMS/email consent runs with the phone number or email account itself (i.e., whoever holds that account is the one enrolled and able to unsubscribe), Ice Castles does not independently verify the age of the person physically completing the opt-in.

CHANGES

We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.
